Terms of Service
Last updated 19 October 2026
These terms are an agreement between you and Orbis Marketing Inc. (“Orbis”, “we”, “us”) about your use of Orbis, the online studio at studio.orbismedia.ca. By creating an account or using Orbis, you agree to them. Please read them together with our Privacy Policy.
1. Who we are
Orbis is run by Orbis Marketing Inc. (Orbis Media), Toronto, Ontario, Canada. You can reach us at team@orbismedia.ca.
2. Your account
- You must be at least 18 years old to use Orbis.
- Your account is for you alone. Keep your password private. You are responsible for everything done with your account, and you should tell us right away if you think someone else has used it.
- Use an email address you can read. We use it for receipts, password resets and important notices about your account.
3. Your balance and what things cost
- Orbis is pay as you go. You add money to your balance by card, through our payment processor, Stripe. All amounts are in US dollars. We never see or store your full card number.
- Orbis shows the price of each generation before you start it. That price is set aside from your balance when you start, and charged when your result is ready. If a generation fails or is cancelled, the amount set aside is returned to your balance.
- We may change prices from time to time. The price shown when you start a generation is the price you pay for it.
- Your balance does not expire. It stays on your account even if you stop using Orbis.
- Your balance is not a bank deposit and earns no interest. It can’t be moved to another account or exchanged for cash.
- Where we must charge sales tax, it is shown before you pay.
4. Refunds
- Money you add to your balance is not refundable, whether you’ve used it or not. Your balance never expires, so it’s there whenever you want to use it.
- If you dispute a payment with your bank instead of contacting us, we may pause your account until the dispute is settled. Money returned to you through a dispute is removed from your balance.
5. Using Orbis responsibly
You may not use Orbis to create, upload or share:
- sexual content involving anyone under 18, which we report to the authorities;
- sexual or intimate images of a real person without their consent;
- content that impersonates a real person, or shows them saying or doing things they didn’t, in a way meant to deceive or harm;
- content that harasses or threatens anyone, or promotes violence or hatred against people;
- content that breaks the law or infringes someone else’s copyright, trademark, privacy or publicity rights;
- spam, malware, scams or other deceptive content.
You also may not try to break, overload or get around Orbis’s limits or security, share or resell access to your account, or use Orbis through automated tools we haven’t approved.
Prompts are checked automatically against these rules, and the AI providers we use apply their own checks. A request that is refused is not charged. We may remove content, and suspend or close accounts, that break these rules.
6. Your content
- You keep ownership of what you upload. As between you and us, what you make with Orbis is yours, to the extent the law allows.
- You give us permission to store, process and send your content only as needed to run Orbis for you: for example, sending your prompt and pictures to the AI provider that makes your result, and keeping your results in your library. We do not use your content to train AI models, and we do not sell it.
- You confirm you have the rights to everything you upload, including the consent of any person who appears in it.
- AI results can be surprising, inaccurate, or similar to results made for other people. You are responsible for how you use what you make, including checking that it doesn’t infringe anyone’s rights before you publish or sell it.
7. When you stop using Orbis
If you don’t sign in or use Orbis for 3 months, we delete the files in your library: the pictures you uploaded and everything you generated. We’ll send a reminder to your account email before we do, so you can download anything you want to keep. Deleted files can’t be recovered.
Your account and your balance stay, and you can start using Orbis again whenever you like. Orbis is not a permanent archive, so keep your own copies of anything important.
8. Closing your account
You can ask us to close your account at any time by emailing team@orbismedia.ca from your account’s email address. We’ll delete your files and personal information, except records the law requires us to keep, such as payment records. Unused balance isn’t refunded when you close your account, so use it first.
We may suspend or close an account that breaks these terms. If we ever stop offering Orbis, we’ll give you at least 30 days’ notice and refund unused balances.
9. Changes
Orbis is growing. We may add, change or remove features and AI models, and we may update these terms. We’ll post the new version on this page with its date, and email you about important changes before they take effect. If you keep using Orbis after a change takes effect, the new terms apply.
10. Services we rely on
Orbis uses other companies’ services, including AI providers, to make your results. They are listed in our Privacy Policy. We’re not responsible for their outages, refusals or results, but you are never charged for a generation that fails.
We advertise on Facebook and Instagram. If you make an account after clicking one of our ads, we let Meta know, as our Privacy Policy explains.
11. No guarantees
Orbis is provided as is and as available. We work to keep it running well, but we don’t promise it will always be available, free of errors, or right for your purpose. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.
12. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim relating to Orbis is limited to the amount you paid us in the 12 months before the claim.
13. Claims about your content
If someone makes a claim against us because of content you uploaded or made with Orbis, or because you broke these terms, you agree to cover our reasonable costs of that claim.
14. Law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be handled by the courts of Toronto, Ontario, unless the consumer laws where you live give you the right to bring them elsewhere.
